A real estate businessman named Marshall Welton lured 17 low-income Hispanic Indianapolis households into a predatory “rent-to-buy” scheme from 2015 to 2017.
He was sued by — and settled with — the Fair Housing Center of Central Indiana for discrimination. According to the legal complaint, he had scammed the tenants by mortgaging their homes and requiring them to sign contracts that made them pay his real estate taxes and disclaim his responsibility to make repairs.
The kicker? Despite a well-documented history of tax delinquency in Marion County and allegations of mortgage fraud exposed by a 2007 IndyStar investigation, he had still managed to sweep up cheap, foreclosed properties at sheriff sales in Indianapolis, and used those derelict, virtually uninhabitable homes to fund his scam
A bipartisan bill making its way through the Indiana legislature would prevent predatory and negligent landlords like Welton from buying foreclosed property in the future.
House Bill 1048 was originally intended to allow sheriff foreclosure sales, which are currently held only in-person, to be conducted online. Rep. Justin Moed (D-Indianapolis) voiced concern that doing so would allow predatory, out-of-state or even out-of-country landlords to snatch up property more easily.
